Out statement about your privacy.

At Noordung, we want to assure that we provide you, as a User, with information and choice about Our policies and practices. We do this so you may make informed decisions whether or not you want to use Noordung Sites and how you choose to use them. 

Please read this Privacy Policy carefully before using Noordung Sites. When you use Noordung Sites, you consent to the terms and conditions and the practices described in this Privacy Policy. It applies to you if you access Noordung Sites directly, through a third-party or by other means. It takes precedence over any conflicting terms published by a third party regarding your access or use of Noordung Sites. 

NOORDUNG SITES, AND THE PRODUCTS, SERVICES AND ADVERTISING MADE AVAILABLE THROUGH THEM, ARE NOT INTENDED FOR USE BY CHILDREN UNDER THE AGE OF 18. Noordung does not knowingly collect any information from children under 18 years of age. We will undertake to delete any details from such users where a parent or guardian has notified us that any such details have been obtained. 

Definitions we use in this Privacy Policy

We use certain defined terms in this Privacy Policy. They have the following meanings: 

"Noordung," "we," "our," and "us" refers to Noordung, Ltd. and any entities that are controlled by or under common control with Noordung, Ltd. 

"Noordung Sites" include but are not limited to all Noordung wired and mobile websites, digital products, services, websites, applications, data, content, advertising, and other elements from which you are accessing this Privacy Policy. These other elements may include sign-up screens, contests, data input and tracking, and other interfaces. 

"Personally Identifiable Information" or "PII" means information by that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. This information includes things such name, address and email address. Your username and a password you supply are examples of PII. Information about a device or the location of a device may be PII. 

"Providers," refers to non-Noordung entities such as, but not limited to, service providers, advertisers, vendors, data collection services and other third parties. These Providers may also collect or receive information about you. 

"User," "you," "your," and "visitor," whether in the singular or plural refers to a natural person who views, downloads or interacts with any Noordung Sites. 

What information do we collect?

We may collect your PII or device information, including your device’s location, when you use the Noordung Sites. Users are informed during the registration or onboarding process for certain Noordung Sites of the information we may collect about you or your device and prompted to provide that information or grant us access to it for specified purposes such as delivering our services, making product improvements, and push notifications. 

Information we ask you to provide. We may ask you to provide PII in order for you to benefit from the specified features or to participate in a particular activity on the Noordung Sites. We may request PII when we ask you to register for fee-based services, although some free products and services may also request or require registration. For example, we may request PII from you when you create an account, download an application or content through Noordung Sites, upload content (e.g., photos, videos) to Noordung Sites, subscribe to e-mail newsletters or other content made available by Noordung Sites, or report a problem with your account or Noordung Sites. As a registered subscriber or user, you may be able to download software, enter contests, order e-mail newsletters or participate in additional services or other promotions offered on Noordung Sites. 

Information your device provides passively about the device, the network it is on and the device's location. Your use of Noordung Sites may result in the assignment of unique identifiers (IDs). Some of these IDs are generated by your device and some of these are provided to your device by us or our providers. These may be in the form or numbers or combinations of letters, numbers and other characters or other codes. These may be used to allow Noordung and its Providers and others who assist Noordung in the support of Noordung Sites to know your device's location, web browsing movements or information about the environment near the device. When you use certain Noordung Sites, we allow you to choose when and how often to share your device location data with us and the purposes for which we or our Providers may use your device location data. 

When you use Noordung Sites, your device may send us some or all of the following: 

  • GPS Coordinates. The GPS coordinates of a device. On many devices, enabling or disabling “Location Services” (or a similar setting) controls whether the device sends GPS coordinates.
  • Internet Protocol (IP) Address. An IP Address is a number automatically assigned by your Internet Service Provider (ISP). The IP address is the host computer a device uses to connect to the ISP's network to send information to us or to our Providers and for a device to receive information back from us or from our Providers.
  • Device ID. A Device ID is a combination of letters and numbers that is unique to the device you are using. The Device ID identifies the device, regardless of who is using the device. On many devices, the Device ID is provided by the device manufacturer and stored permanently in the memory of the device. Depending on how the manufacturer configured the device, you may not be able to change it.
  • Advertising ID (AAID) or ID for Advertising (IDFA). These are combinations of letters and numbers that are unique to the device you are using. However, these identifiers may not be permanent. Depending on your device, you may be able to reset them through the settings of your device or your browser.
  • Information about the performance of your device. This may include information such as the operating system and version the device is using and the version of our application the device is using.
  • Cookies. Cookies are files with small amounts of data, which may include an anonymous unique identifier. If you are accessing an Noordung Site through a browser, including a browser on a mobile device, cookies may be sent to the browser and stored in the device's memory. This identifies the device the next time it accesses an Noordung Site through a browser. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not permit the device to accept cookies, your experience may not be optimal when you return to an Noordung Site because we may not recognize the device. We use both “session cookies” or “persistent cookies.” Session cookies are temporary and expire once you close your browser or once your session ends. Persistent cookies remain on your device for much longer or until you or your browser erase them. Persistent cookies have varying durations that are dependent on their expiration date. Cookies help us improve the Noordung Site by providing us with information about which parts of the Noordung Site are most popular, enabling us to analyze technical and navigational information about the Noordung Site, and helping us to detect and prevent fraud. We also use cookies and other data collection tools to help improve your experience with the Noordung Site. These tools use cookies to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the Noordung Site (including IP address and geolocation) is transmitted to our data collection tool Providers. This information is then used by us to evaluate visitors’ use of the Noordung Site and to compile statistical reports on website activity for us.
  • Pixel Tags, Web Beacons, Flash Shared Objects/HTML5 Local Storage/HTML5 Mini Databases. Many mobile devices use these technologies which allow for the storage of information on the mobile devices and, in effect, allow the enhancement of internet browsing. The Flash Shared Objects, HTML5 Local Storage and HTML5 Mini Databases also allow the device to track a user's web browsing movements across the internet and not just on one particular website.

If you turn off "Location Services" or a similar setting that controls GPS functionality, the device still may automatically send or receive this other information as long as you have these other communications types enabled. You should read the instructions related to your device, operating system or browser to learn about how to control the information your device may transmit. 

Air-Quality observations, photos, videos and other information you choose to upload or submit to us. You may have the opportunity to submit information about yourself and your surroundings, such as Air-Quality data you observe, as well as your present precise geolocation or another location of interest. You also may be able to post or submit photos, videos, graphics, information, comments, and other content to an Noordung Site. When you submit this information, it becomes the property of Noordung, and you accept responsibility for its accuracy, appropriateness and legality. It may be distributed and become publicly available. It may be viewed, read, collected, or used by others, outside of our control, including any geo-location, tags, or other metadata in the submission. 

Information about you that you choose to share through Social Media. You may engage with our content on or through social media services or other third-party platforms such as Facebook, Instagram, X and others that are integrated to an Noordung Site. We refer to those here generally as "Social Media." You should read the privacy policies and terms of use of the Social Media platforms you use and check your privacy settings on those Social Media platforms. 

Information you provide Noordung if you contact us directly. If you contact Noordung, we may keep a record of that contact or correspondence.

Your Mobile Device SMS / Text Messages. You may decide to opt-in and consent to receiving SMS / text messages from Noordung. If you do, we will collect your phone number. By providing your phone number and clicking submit online, you agree to our Terms of Use and this Privacy Policy, and authorize us to make or initiate sales calls, text messages and prerecorded voicemails to that phone number using an automated system. Your agreement is not a condition of purchasing any products, goods or services and you may elect to do business with us over the phone. Message & data rates may apply and message frequency may vary. 

How do we use this information?

It is important for us to know our users. Noordung uses the information it collects to:

  • Provide the Noordung Sites to you and to improve the Noordung Sites
  • Create and manage your account with Noordung
  • Operate, improve and personalize the products and services we offer and to give each user a more consistent and personalized experience when interacting with us
  • Provide you Air-Quality alerts at the location(s) you provide us
  • Provide you a user-friendly and engaging service with content we believe will be most relevant to you
  • Analyze the traffic and use patterns on Noordung Sites
  • Provide you up-to-date information on our products, our services and the Noordung Sites
  • Process and verify subscriptions, including payment related to such subscriptions
  • Bill for subscription-based Noordung Sites and other services
  • Process your data rights requests
  • Respond to your inquiries and requests
  • For security, to detect fraud or illegal activities, and for archival and backup purposes in connection with the provision of the Noordung Sites
  • For our business purposes, such as data analysis, audits, developing new products, enhancing the Noordung Sites, improving our products and services, identifying Noordung Site usage trends, and determining the effectiveness of our promotional campaigns
  • As we believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities; (iv) to enforce this Privacy Policy and Our Terms of Use; (v) to protect our operations or those of any of our affiliates; (vi) to protect our rights, privacy, safety or property, and/or that of our affiliates, you, or others; and (vii) to allow us to pursue available remedies or limit the damages that We may sustain.

How do we share this information?

We may disclose information to our affiliated companies.

We also may disclose information to unaffiliated third-party Providers. We deliver valuable information to you on Noordung Sites free of charge or at low rates. We can accomplish this by working with Providers, who may receive or collect your PII to provide services to us or for their own purposes. 

These unaffiliated third-party Providers may:

  • Provide services to us, such as website hosting and moderating, mobile application hosting, data analysis, payment processing, order fulfillment, infrastructure provision, IT services, providing chat functionalities, customer service, e-mail and direct mail delivery services, credit card processing, auditing services and other services. We need to provide certain information in order to enable them to provide those services to us. For example, We may use Providers to administer the process for you to make submissions of videos to Nooredung Sites and/or to host or store such submissions for us.
  • Use the information to offer promotions to you for other products and services. For example, many wireless products may be made available through cooperative arrangements with Providers who offer specialized products, information or services that we believe work well with the Noordung Sites.
  • Use the information in combination with other information. Providers may have obtained other information directly from you or from other sources that are not related to us and not related to your use of Noordung Sites.

We also may disclose PII we collect if we think it is necessary under applicable law or to comply with legal process, such as a court order or subpoena. This may include laws outside your country of residence. 

We may also disclose PII as we believe to be necessary or appropriate:

  • to comply with legal process
  • to respond to requests from public and government authorities, including public and government authorities outside your country of residence
  • to support external auditing, compliance and corporate governance functions
  • to protect our rights, privacy, safety, or property or yours or to pursue available remedies or limit damages we may sustain
  • to a third party in the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with a bankruptcy or similar proceeding).

Where is the information stored?

Noordung Sites are controlled and operated from within the European Union. PII may be stored and processed in any country where we have facilities or Providers. When you consent to use Noordung Sites, you are consenting to the transfer of information to countries outside of your country of residence, including to the European Union, which may provide for different data protection rules than in your country.

How long is the information stored?

We retain PII for as long as you have a registered account with us or as long as needed to provide you services on the Noordung Sites or as required by applicable law. If you request that we delete or restrict certain PII about you controlled by us, we will comply with your request where necessary, but we may retain and use the PII for a period of time. For example, we may use the records to follow-up on a request, resolve a dispute or as needed to comply with applicable law. In addition, some PII may be stored on back-up files for financial, legal, or technical reasons.

How can you access and control your information

Accessing, deleting or correcting your PII. If you would like to access, delete or correct the PII Noordung maintains about you, please please send us an email at: privacy@noordung.com.

Controlling information your device sends to us. Most devices and web browsers offer privacy settings and options where you can control the information that your device sends. You may disable cookies, reset your IDFA or AAID, or turn off location-based (GPS) services. We do not override these settings or options, and you can change them at any time. We encourage you to use them to enhance your choices and personalize your experiences. However, in order to access certain content, features, services, products, or benefits of Noordung Sites, you may be required to provide us certain information. Basic Noordung app features will still function if you choose not to share your device location with us. 

Accessing and updating your online account information. If you have a subscription or account with us where you voluntarily provided PII through email, registration forms, the best way to access or control this information is to visit the applicable Noordung Site to update your profile or change your password. If you have a user name or password associated with an account, you are responsible for maintaining the confidentiality of your user name and password. 

EU/UK/Switzerland Residents

Regulation (EU) 2016/679 (“GDPR”), any national law of an EU member state adopted pursuant to the GDPR, the U.K. Data Protection Act of 2018, and the Switzerland Federal Act on Data Protection (collectively, “Data Protection Laws”) provide EU, U.K. and Swiss residents with specific rights regarding their PII. The below describes such rights and how you (if you are an EU, U.K. or Swiss resident) may exercise such rights, and our information practices, including our legal bases for processing Your PII.

The categories of PII We process about you is set forth in the section entitled “What Information do we collect?”. The purposes for processing such PII are set forth in the section entitled “How do we use this information?”. 

Our legal bases for processing PII are as follows: 

  • Performance of Contract. We may use your information to perform our contractual services or prior to entering into an agreement with you. If you use the Noordung Sites or if you contact us to request services, we use your information to provide to you the features and functionality of the Noordung Sites and our products and services, including for customer service.
  • Legitimate Interest. We may use information for our legitimate interests, except where such interests are overridden by your interests or fundamental rights and freedoms. For instance, we may use your PII to contact you and respond to your requests and inquiries, to administer our business, to identify prevent and detect fraud or to pursue or defend ourselves against legal claims.
  • Consent. We may use your information with your consent. In these instances, we will ask you to grant us consent to use your information. You are free to grant or deny permission. If you deny permission, we will not be able to process your information to conduct the activity to which the consent relates. For example, we will not be able to send you marketing materials that you request. You are also free to withdraw your consent at any time. A withdrawal of consent will not affect processing that has been completed during the time in which the consent was valid. If you have granted us consent to use your information, we will use it only for the purposes specified when we request your consent. This includes use for our marketing campaigns. If you sign up for our email newsletter, you allow us to use your email address for marketing related to the Noordung Sites, and our services and products. You may unsubscribe from such emails at any time by following the link to unsubscribe at the bottom of our marketing emails. You may also contact us to request that we remove you from our email list. However, please note that unsubscribing may prevent you from receiving email messages regarding updates, improvements, or offers.
  • Fulfillment of Legal Obligations. We may use your information to comply with our legal obligations. To comply with regulations, laws or any authority requests, we may disclose your information to authorities or other officials or otherwise process your information pursuant to legal obligations we are subject to (e.g., retain certain information according to tax or commercial laws, respond to your requests to exercise your rights under Data Protection Laws).

We disclose the PII we process about you with the third parties set forth in the section entitled “How do we share this information”. 

As mentioned in the section entitled “How long is the information stored?”, we will retain your PII for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable laws or regulation. Copies of information that you have updated, modified, or deleted will remain in our systems if applicable law requires us to retain it. 

As mentioned in the section entitled “Where is the information stored?”, We provide the Noordung Sites from servers located in the European Union. 

You have the right to request that we confirm what PII we collect or hold about you, provide a copy of your PII to you in a machine-readable format and to ask us to correct or update the PII. You also have the right to ask us to delete your PII that we hold, in accordance with applicable law. However, the deletion of the PII may impact your access, use and ability to use features on the Noordung Sites. You have the right to restrict our processing of your PII under certain circumstances. Additionally, you have the right to object, on grounds relating to your particular situation, at any time to our processing of your PII, which is based on public interest or our legitimate interests, including the profiling of data. In this case, we will stop processing your PII, except for where we have compelling legal grounds for the processing which override your interests, rights and freedoms, or for the exercise or defense of possible legal claims. You further have a right to object to the processing of your personal data for direct marketing purposes.

Data Security

We employ technical and organizational security measures designed to protect the security of information submitted through the Noordung Sites. However, the security of information transmitted through the Internet can never be guaranteed. We are not responsible for any interception or interruption of any communications through the Internet or for changes to or losses of data. Users of the Noordung Sites are responsible for maintaining the security of any password, user ID or other form of authentication involved in obtaining access to password protected or secure areas of any of the Noordung Sites. In order to protect us, you and your data, we may suspend your use of the Noordung Sites, without notice if any breach of security is suspected. Access to and use of password protected and/or secure areas of the Noordung Sites are restricted to authorized users only. Unauthorized access to such areas is prohibited.

A note about links to external websites / online services from Noordung Sites

The Noordung Sites may contain links to third-party websites and online services. Any access to and use of such third-party websites and online services is not governed by this Privacy Policy but is instead governed by the privacy policies of those third-party websites and online services, and we are not responsible for the information practices of such third-party websites and online services. You should read and understand such third-party websites and online services' terms of use and policies before using their sites or entering into agreements with them. If you have questions or concerns about their sites, terms or conditions, or privacy policies, you should contact the third party directly. Noordung neither endorses nor accepts responsibility for the contents of the third-party websites or online services. For convenience, we may provide information and contact information about our Providers, but we cannot ensure that the contact information is correct or accurate.

Use by children under age 18

Noordung Sites are not directed to children and Noordung does not intend to collect any PII from children. Please do not allow children under age 18 to use Noordung Sites, provide any PII to Noordung, or ask questions on Noordung Sites. If w are notified with verifiable information that a child under age 18 has provided PII to Us, we will delete that information as soon as reasonably possible. If you become aware that a child under age 18 has provided such information, please send us a detailed email with all identifiable information at privacy@noordung.com so we may delete this information. We have no way to control the use of an access device that you allow a child under age 18 to use, and therefore the device may be sending us information about the device's location and other factors. PLEASE EXERCISE CONTROL OF YOUR DEVICES TO PREVENT MINORS FROM GETTING INTO A SITUATION WHERE THEIR LOCATION MAY BE DISCLOSED TO US, OUR PROVIDERS, OR OTHER THIRD PARTIES.

As Noordung expands its offerings and as technology evolves, we may, from time to time, update our privacy practices to address these changes. We encourage you to check here on a regular basis for updates to this Privacy Policy. If we make any material changes to this Privacy Policy, we will notify you of such changes.

IT'S REALLY ABOUT THE ENVIRONMENT
